Ex-cop sues MTA for $10M over fatal Metro-North crash

A former city cop slapped the MTA with a $10 million suit for injuries he sustained during last year’s deadly Metro-North derailment — bringing the total number of suits against the agency for the accident to six.

Retired Finest Eddie Russell, 48, was “severely damaged” by the Dec. 1, 2013 incident that injured 63 and took four lives, according to his Bronx Supreme Court lawsuit filed on April 4.

His attorney, Robert Vilensky, said the suit’s dollar amount is so high because of the recent Federal Railroad Administration report that found, “Metro-North has emphasized on-time performance to the detriment of safe operations.”

Vilensky said the transportation authority still has not set up a process to settle the claims, which means Metro-North and the MTA will be “costing taxpayers additional expenses” for legal fees.

Twelve other individuals have filed five suits including former military dentist Denise Williams and good Samaritan Carl Short, who used a scarf to help a bleeding victim.

The MTA did not immediately comment.
