‘Good Day’ ma served

Mamma Scotto could be in hot water.

A Midtown restaurant owned by the mother of “Good Day New York” co-host Rosanna Scotto was slapped yesterday with a federal lawsuit claiming that it stiffs its waiters, especially when it comes to overtime.

Gary Gilliam, a former waiter at Marion Scotto’s East 52nd Street eatery, Fresco by Scotto, claims in the suit that he was not paid for hours he worked and that he was deprived of overtime and forced to share tips.

“His checks were always for less than the hours he worked,” said his lawyer, Maimon Kirschenbaum.

The restaurant denies any wrongdoing.

According to the Scotto family, Gilliam had been illegally collecting unemployment for the 18 months he had worked at the restaurant.

Kirschenbaum dismissed that charge as “irrelevant.”
