MOMS PACK JURY OF ‘SLAY’ DAD’S FEARS

When the beastly stepfather of tragic schoolgirl Nixzmary Brown goes on trial tomorrow for allegedly beating the emaciated 7-year-old girl to death, he’ll likely find few sympathetic faces in the jury box.

With jury selection completed yesterday, the fate of Cesar Rodriguez, 29, will rest in the hands of 11 women and just one man. At least three of those women are divorced – and nine have children of their own.

According to prosecutors, Rodriguez flew into a rage on the night of Jan. 11, 2006, after Nixzmary took a yogurt from the refrigerator and jammed up his printer with toys.

He allegedly bashed her head against a tub faucet while running cold water over her as punishment.

Ten of the jurors are black, and two are white. They range in age from their 20s to their 50s.

Lawyers for both sides also selected three alternates yesterday in case any of the 12 jurors cannot continue during the trial, which is expected to take five weeks. Three more will be selected today.

Despite the jury’s makeup, defense lawyer Jeff Schwartz left Brooklyn Supreme Court saying he got the panel he wanted.

“It seems like both us and the DA have the same strategy of looking for women,” said Schwartz. “So we’ll see who’s right.”

The defense lawyer said he believed female jurors might be more receptive to his client’s claim that Nixzmary was a misbehaving child out of control and his assertion that it was the girl’s mother, 29-year-old Nixzaliz Santiago, who actually delivered the death blow.

“They know what it’s about to take care of children,” he said. “I think that women could possibly be more critical of how a woman conducts herself.”

Experienced defense attorneys said that while Schwartz’s strategy might at first seem surprising, it could work.

“Women can look with scorn on other women, just as men can look with scorn on other men,” said veteran defender Steve Chaikin.
