BELL JUDGE WON’T DISMISS CHARGES

A Queens judge today denied a motion to dismiss charges against three undercover cops on trial for unleashing a 50-shot barrage that killed Sean Bell.

The defense argued before Judge Arthur Cooperman, who will decide the case without a jury, that prosecutors failed to prove their case against Detectives Gescard Isnora, Michael Oliver and Marc Cooper.

The request – known as a trial order of dismissal – is standard at the end of most trials, although rarely granted.

After a brief break for lunch, Cooperman denied the request to dismiss the eight counts – paving the way for both sides to deliver their closing arguments on Monday.

Isnora and Oliver face up to 25 years behind bars on charges of first and second-degree manslaughter, felony assault and reckless endangerment. Cooper could get a year in prison if convicted of reckless endangerment.
