‘TAPE’ WORM COOK IN THE SOUP AGAIN

The penal code may have finally caught up with Peter Cook.

Supermodel Christie Brinkley’s cheating hubby may have committed a felony and could face prison time if the amorous architect turns out to be the person who se cretly videotaped himself having sex with teen mistress Diana Bianchi, her lawyer told The Post yester day.

Joseph Tacopina, who repre sents Bianchi, said his client was looking into making a criminal complaint against Cook with Suffolk County prosecutors, accusing him of second-degree unlawful surveillance.

The Post reported on Wednesday the existence of still photographs from a raunchy home video featuring Cook and Bianchi having intercourse on a brown love seat in what appears to be his Southampton office, where she also worked.

The photos, which have been seen by The Post, also show Bianchi – who was 18 when the two-year affair started in 2005 – performing a striptease as Cook holds his crotch.

“We’re reviewing our legal options, and then we’ll sit down in the very near future and make a decision,” said Tacopina, who was also considering filing a civil suit against Cook after learning of the tape’s existence. “We’re gathering information daily.”

The section of the state penal code – 250.45, Subsection 1 – makes it a class-E felony for a person to videotape another person undressing without her knowledge.

The charge carries a maximum sentence of three years.

In July, Cook, 49, and Brinkley, 54, finalized their divorce, caused in part by his affair with Bianchi.

Brinkley obtained full custody of their children, Jack, 13, and Sailor, 10, in the settlement. Cook has visitation rights.

During the trial, Cook revealed that he had a $3,000-a-month Internet-porn habit and that he had posted revealing videos of himself on the Web.

In a separate civil suit, Cook reached a $300,000, out-of-court settlement with Bianchi.

Bianchi is furious with Cook about the taping, but Cook refused to even acknowledge the existence of the explicit footage.

“I have no comment on this crap,” he told The Post. “I don’t know what she’s doing or why she’s doing it.”

But Tacopina, noting that Bianchi had had no idea their trysts were being taped, said it was outrageous for Cook to suggest that she was somehow to blame for any publicity.

“I’ll tell you one thing – it’s not helping Peter Cook’s cause out there,” he said. “Once again, [he is] trying to blame Diana Bianchi for his despicable acts.”
