Arguing that prosecutors had turned their case into a traveling road show, John Gotti Jr.’s lawyer argued yesterday that the case brought against their client in Tampa, Fla., should be shipped back to New York.

Gotti has been tried three times in New York and wound up with three hung juries.

Prosecutors noted that the Florida case involved crimes allegedly committed there, but Judge Steven Merryday wondered aloud whether they are trying to “serially prosecute” Gotti in one city after another until they secure a conviction, The Tampa Tribune reported.

After hearing two hours of arguments, Merryday said he would issue a written ruling “in short order” but did not specify when.
