‘Pot’ tenant: Off my ash!

A Manhattan man facing eviction after being repeatedly warned about an “odor of marijuana” coming from his midtown apartment is taking legal aim at his landlord.

Sebastian Rosario of 340 E. 34th St. says he’ll mount a class-action lawsuit against his landlord for harassing him and trying to oust him from his home.

The Manhattan man’s alleged smoking habits have been firing up neighbors in the Murray Hill building, who keep complaining about “strong smoke odors, including the odor of marijuana,” coming from Rosario’s second-floor pad, according to court papers filed last week.

The aghast landlord claims the smell might “possibly [be] as a result of illegal drug use,” according to court papers.
