Sex-cop vic gets justice

Seventy-five years in prison? Fine by her.

Disgraced sex-assault cop Michael Pena’s victim wanted to see what justice would be meted out to her brutal tormentor before deciding whether to pursue a retrial on the rape charges for which he was acquitted.

And now that his sentence means he’ll die in jail, she is expected not to seek a retrial on those counts, a law-enforcement source told The Post.

“She’s been waiting to see what would happen at sentencing,” said the source. “The decision has always rested with her, as to whether there will be a retrial or there won’t be a retrial.

“The perception is that she is not going to want to go through the ordeal of another trial just so that Pena gets more time on top of what’s essentially already a life sentence,” the source said.

The victim has until the ex-NYPD fiend’s next court date, May 23, to make a final decision.

On that date, prosecutors have said they will tell the trial judge, Manhattan Supreme Court Justice Richard Carruthers, whether they will pursue a retrial.

But even without any additional convictions, Pena would have to live to be 103 before he could see a parole officer, and the added 25- year sentence he could get for the rape counts would likely be moot.

The source said the young victim did not want to relive the horrific details of the brutal attack again.

A jury last March convicted Pena of oral and anal sodomy, but deadlocked on two counts of first-degree rape and two counts of predatory sexual assault after two jurors held out on those charges.

If prosecutors decide not to pursue those counts, they will be dropped.

Meanwhile, Pena, 28, remained in protective custody at Rikers Island in a unit that houses 14 single-person cells.

The thug pulled his service weapon on the terrified young schoolteacher, then 24, last August on what was to have been her first day on the job.

Pena dragged her into an Inwood alley, repeatedly threatened to “blow your f–king face off,” and sexually assaulted her as frantic neighbors called 911 to report the attack.

The emotional victim told Carruthers that her life was “shattered” by the brazen assault.

She said her world would never be the same, and that the attack would haunt her every day for the rest of her life.
