Assaulted educator wrongfully fired: judge

A teacher with a spotless 22-year record was unfairly canned for having problems controlling an eighth-grade class that included students who assaulted her, a Manhattan judge has found.

The hearing officer who recommended Naomi Davies be fired for incompetence didn’t consider the city Department of Education’s culpability in her problems handling unruly students, Justice Manuel Mendez ruled.

That’s because, she says, the brass at the East Bronx Academy of the Future let students who had allegedly assaulted Davies remain in her class without taking any action against them.

In one case, Davies had to call cops after a student injured her hand and wrist — and got chided for having done so, her filings say.

The student was later convicted of a related charge and ordered to stay away from her for two years.

The DOE had blamed Davies for the many problems with her classes, including one in which student tossed soda cans, heated their textbooks in a microwave, and walked in and out of class.

The DOE said Davies shunned the school’s offers of training in how to deal with the students, which the teacher denies.

In court filings, she also claims the school stacked the deck against her, assigning her at-risk students.
