Smith’s busted driver got 5G ‘pot’ of gold

State Sen. Malcolm Smith’s driver is due in court tomorrow after being busted for driving while smoking pot.

But instead of being disciplined by the embattled lawmaker, the chauffeur got a $5,000 raise.

Robert Flake, 32, son of power broker Queens preacher Floyd Flake, was arrested in the Meatpacking District in August after a traffic cop whiffed a “strong odor of marijuana” from Flake and the Chevy he was in, according to court records.

“I’m stupid — I shouldn’t have been smoking,” Flake, of Hollis, Queens, allegedly told the officer. “I have half a bag in the car.”

The cop noticed Flake’s “watery and bloodshot eyes,” as well as slurred speech and “mussed” clothes, according to a court document.

Police found not the half bag Flake claimed to have, but three bags of weed in the Chevy’s console, court documents showed.

Despite the bust, Smith rewarded Flake with the $5,000 raise — to $50,500 annually — in January, just five months after the arrest.

Flake’s status hearing tomorrow will likely determine whether his case is adjourned or goes to trial.
