Cop smashed my bike, then gave me a ticket: lawsuit

A motorcyclist who tried to get out of the way of an emergency vehicle in Midtown was smashed by a police car — then slapped with a summons, he claims in a lawsuit.

Nicholas Campbell, 39, was waiting at a traffic light at 42nd Street and Fifth Avenue in September 2012 when he heard a siren behind him.

He moved into the right lane to let the emergency vehicle pass and was hit by a patrol car, he says in a Manhattan Supreme Court suit.

Then a cop added insult to injury, the construction worker claims.

Campbell, who was sent flying onto 42nd Street, was “briefly detained,” attorney Joshua Fitch said.

Lt. Christopher Cheng, the cop at the wheel, issued the biker tickets for an improper right turn and failing to obey a traffic-control device, Campbell says in court papers.

Fitch claims the cop lied to cover his mistake.

“If the cop says it’s his [Campbell’s] fault, then there’s no claim,” he said.

Campbell is seeking unspecified damages. The summonses are expected to be dismissed.

The city’s Law Department is reviewing the claim.
