Bonehead attorney outs client’s ‘assault’

The lawyer for a man accused of murdering a transsexual prostitute opened a huge can of worms against his own client during cross examination of the accused killer’s ex-girlfriend Tuesday in Queens Supreme Court.

Prosecutor Karen Ross had simply called Rasheen Everett’s ex to identify the accused killer on a surveillance video taken from the hallway of victim Amanda Gonzalez-Andujar’s apartment building.

In a clear case of ignoring the golden rule that a lawyer should never ask a witness a question he doesn’t already know the answer to, defense attorney John Scarpa, on cross examination, casually asked Everett’s former lover, Sarah Frezee, why they broke up.

“Our breakup was because he choked me,” she responded, adding, “I dislike him for what he did to me.”

Some of the juror’s appeared stunned — one woman covered her mouth, while another shook his head in disbelief.

“And this is your opportunity for revenge,” Scarpa barked back at the witness after his gaffe.

Frezee, 25, denied the accusation and Queens Supreme Court Justice Richard Buchter struck Scarpa’s comment.

Everett, 32, faces 25 years to life in prison for allegedly strangling Gonzalez-Andujar inside her ransacked first-floor Glendale apartment on March 27, 2010. The transgender prostitute’s body was found naked and lying face up in bed.

Everett is allegedly seen on camera entering the 62nd Street building and exiting 17 hours later with two pieces of luggage belonging to Gonzalez-Andujar, according to the victim’s sister’s testimony.

After the defense’s hiccuped line of questioning, Ross entered several pictures of Frezee’s wounds and an order of protection she took out against Everett to prove the April 2008 incident.

“I wanted to make sure there was a record of what he did, and my mom took pictures,” said Frezee who claims she was held captive for almost a week after the beating in the New Jersey apartment where they lived together.

Everett, who was employed as a driver for NBC Studios, was apprehended at a friend’s residence in Las Vegas and was brought back to New York by Queens homicide detectives on April 14, 2010.
