Yankees fan hit in the face by foul ball loses injury lawsuit

A Manhattan appeals court gave no relief to a Yankees fan whose face was partially cratered by a foul ball, finding that the Upper West Sider should have read the warnings on the back of his ticket.

Developer Andy Zlotnick was seated about 200 feet from home plate on the right-field side in August 2011 when Bronx Bomber Hideki Matsui slammed a line drive into the stands.

“It felt like a mortar exploding into my face,” Zlotnick recalled in an interview with The Post last month.

The foul ball left him with a damaged left eye socket and fractured cheekbones — and $160,000 in medical bills for reconstructive surgery.

The 56-year-old dad sued in Bronx Supreme Court, challenging the so-called “Baseball Rule” that says fans attend games at their own risk.

The case was dismissed by a lower court in 2015, but Zlotnick appealed, arguing that the Yankees should have done more to keep fans safe.

He has said he had no chance against the ball, which he couldn’t even see coming toward him because of other fans’ open umbrellas around him during the rainy match-up.

But a four-judge appeals panel ruled Tuesday that Zlotnick should have realized that open umbrellas might obstruct his view of an incoming ball.

“Rainy weather and umbrellas are not uncommon to the game of baseball, and [Zlotnick] admittedly used his own umbrella during the course of the game before being struck by the foul ball,” the judges said in the unanimous decision.

“The circumstances presented warranted [Zlotnick] heeding the warnings on the back of his ticket, and on the back of the seats, as well as those regularly made over the public address system,” the panel wrote.

The judges also found that the stadium had “appropriate netting … behind home plate” even though the Yankees have since decided to add more protection after a 2-year-old was struck by a 105-mph ball hit by third baseman Todd Frazier in September.

A rep for the Yankees did not immediately respond to a message.

Zlotnick said, “We are reviewing the decision and considering our options with respect to further appeal.”
