City probing how tragic toddler crawled out 6th-floor window

The city Health Department is investigating the death of a toddler who fell from a Bronx apartment window to see if the the building was in compliance with window-guard regulations, officials said.

Cops said there would be no criminal charges filed after 2-year-old Nayvem Santos tumbled five floors to his death early Sunday from an open apartment window at his grandmother’s home in Melrose.

But the representatives from the Health Department, Housing, Preservation and Development and the Administration for Children’s Services descended on the Gerard Avenue building Monday looking for clues to explain the tragedy.

Cops and neighbors said the boy placed a pot in a chair, climbed on top of the pot and then fell through a gap between the window and a lower window-guard while his grandmother was sleeping.

“It’s awful,” said neighbor Jose Guzman. “We don’t understand how he managed to fall out. The window guards are still in place. We only imagine that he climbed on a chair and went over the gate.

“Everyone needs to be more cautious now. I saw the grandmother. She’s devastated. There are no words right now.”
