Judge slams Robert Jackson, wife for omissions in lawsuit

A state judge rapped state Senate candidate Robert Jackson and his wife, Faika, for failing to disclose medical information related to a negligence lawsuit they filed against the city and Fairway supermarket four years ago.

Faika Jackson claimed she got hurt after tripping over a downed stop sign on the pavement outside the grocery parking lot at the corner of W. 133rd Street on April 15, 2010.

Faika Jackson wants to be compensated for her injuries.

Robert Jackson, the former city councilman, joined the suit as a co-plaintiff because his wife’s injury deprived him of her “services, society and companionship.”

But court records show that the Jacksons for two years failed to turn over medical documents requested by Fairway’s lawyer about the extent of her injuries, and the medical bills associated with them.

Manhattan Supreme Court Judge Marget Chan criticized the plaintiffs for dragging their heels in the ongoing case.

“Defendant Fairway Uptown LLC is entitled to the relief it seeks – preclusion of plantiffs’ evidence against it – due to plaintiffs’ non-compliance with Fairway’s repeated discovery demands,” the judge said in a Jan. 14, 2013 order.

Jackson, who is challenging incumbent state Sen. Adriano Espaillat in the Democratic primary for northern Manhattan’s 31st district, defended the suit.

“My wife suffered permanent injuries to her head, body and ongoing complications resulting from the negligence of the defendants. However, because these injuries are the subject of ongoing litigation, I cannot comment further on the case,” Jackson said.

The city Law Department and Fairway declined comment.
