Triathlete who suffered brain injury wants defective helmet back

A Manhattan athlete who suffered a traumatic brain injury during the 2012 New York City Triathlon wants his bicycle helmet back.

John Draghi, 55, believes the headgear was defective and led to his grievous injury, and wants a judge to force the race organizers or medics to return it if they have it, according to Manhattan Supreme Court papers.

He is seeking a court order to compel the New York Triathlon Club, sports management company Korff Enterprises, or Senior Care EMS, which took him to the hospital, to turn the helmet over.

The Upper West Sider was on the Henry Hudson Parkway just south of the George Washington Bridge when his bike crashed.

He believes the helmet’s restraint system failed.
