This upstate man looks like he didn’t know whether to laugh or cry after he was busted for drunk driving Wednesday morning.
State cops pulled over David J. Myers, 27, after spotting him swerving across lanes while driving on Route 82 in East Fishkill at 2:10 a.m., police said.
Myers looked drunk, they said, and a breath test showed he had a blood alcohol count of .11, they said.
State police from the Wappingers barracks gave him a ticket for driving while intoxicated and released him pending a court appearance in East Fishkill, his hometown, on July 30.
Trooper Melissa McMorris said she was not sure what was going through Myers’ mind when he struck the bizarre pose for his mug shot.
“He was not aggressive. I would imagine he was cooperative,” she said.
Myers told The Post he wasn’t drunk – and explained that he made the face as a prank.
“I was just cracking jokes with the officers and that was it,” he said.
