Suspects claim teen was having sex with father before alleged gang rape

The fifth and final suspect in the horrific gang rape of a Brooklyn teen was nabbed at school Tuesday — while two of his accused pals claimed the girl was having sex with her dad before they got there and that she gave them consent, law enforcement sources said.

Two of the suspects — Shaquell Cooper and Ethan Phillip, both 15 — grinned as they were being hauled off to court to face charges Tuesday.

Cooper, Phillip and two alleged cohorts — Denzel Murray, 14, and Onandi Brown, 17, of Brooklyn — were charged as adults with rape, forcible compulsion, criminal sex act and sex abuse.

The fifth suspect, Travis Beckford, 17, was taken into custody at Samuel J. Tilden High School at about 11 a.m. Tuesday, according to authorities. Police filed the same charges against him, and he too was expected to be prosecuted as an adult, sources said.

Two of the teens admitted to cops that they had sex with the 18-year-old girl after finding her drunk in the Osborn Playground in Brownsville at about 9 p.m. last Thursday, but they insist it was consensual, sources said.

They said she was having intercourse with her boozed-up dad before they had sex with her, law enforcement sources said.


One of the boys took out his cellphone and recorded video — catching the woman with her pants down as her father stood nearby, the suspects’ relatives said.

In a short clip of the footage viewed by The Post, a young woman can be seen sitting on the ground rocking back and forth and grinning. There is the sound of young men laughing in the background.

One of the teens says to the older man, “Can we have some of that?,” according to a law enforcement source.

A teen can then be heard telling the girl, “You said, ‘Yeah.’ That’s what I’m saying, it’s lit [OK], like you know what I mean? I could tell you a freak.’’

The drunken dad staggered off and, when he returned, threw a beer bottle at the teens, according to law enforcement sources.

The father told cops he eventually went to two nearby delis for help, but workers there have said he was too drunk for them to understand him. In the end, he flagged down a passing patrol car.

The father told cops he fled the rape scene because one of the teens had a gun. A weapon has yet to be recovered.

Phillip’s brother, Billy Anderson, 24, and mother say the video shows that the boys’ sex with the girl was consensual and that the victim and her dad made up the rape tale to cover up their actions.

“All of that she said is a lie. If that was supposed to be her father, then you know she was in the park f–king her father,” Anderson said. “She was basically telling them, ‘You could do it.’ This video is basically proving that whatever [their] story is, it’s false.”

Phillip’s mom, who would not give her name, added, “She was laughing, and they walked up on her like that. That’s her! She don’t have on no pants. This is before everything. She was out there having sex with the man that say he was her father.”

Cops were waiting for a search warrant before they viewed the cellphone video.

Four of the suspects — Cooper, Brown, Phillip and Murray — appeared Tuesday night in Brooklyn Criminal Court, where an assistant DA admitted that none of them could be ID’d in police line-ups.

Prosecutors requested that Cooper be remanded and the other suspects be held in lieu of $500,000 bail. But the judge ordered that Cooper be held in lieu of $50,000, Brown $25,000 and Phillip and Murray $10,000. Beckford had not yet been arraigned.

A lawyer for Murray said the complaint did not even allege that his client engaged in sexual activity with the victim. Also, a lawyer for Brown blasted the arrests as politically motivated.

“The case is weak,” said the lawyer, Spencer Leeds.
