‘RAPE’ POL NIXES DEAL

Queens Councilman Dennis Gallagher, under indictment for rape, has turned down a plea deal that would keep him out of jail, The Post has learned.

Under the rejected offer, the pol would have admitted to felony assault, but not to a sex crime.

Gallagher pleaded not guilty in August when he was arraigned and vowed he’d be “vindicated.”

Sources said the offer was made during recent discussions between Queens District Attorney Richard Brown’s office and Gallagher’s lawyers.

Brown declined comment. Gallagher’s lawyer, Benjamin Brafman, couldn’t be reached.

Under the deal, Gallagher would not have had to register as a sex offender.
