Brooklyn hate-slay mistrial

The case of a man accused of the hate-crime murder of an Ecuadorian immigrant ended in a hung jury last night.

The entire Brooklyn Supreme Court jury didn’t buy prosecutor’s arguments that Keith Phoenix, 30, attacked José Sucuzhanay, who was walking arm-in-arm with his brother in December 2008, because Phoenix thought the victim was gay, one juror told The Post.

Eleven of the panelists — who had been deliberating since last Wednesday — wanted to convict Phoenix on murder charges. The lone holdout thought he should be found guilty of manslaughter, juror Guy Danza said.

Phoenix was remanded to stand trial again. His alleged cohort, Hakim Scott, was convicted of manslaughter by a separate jury last week.

“I hope we have success in the new trial,” said the victim’s brother, Romel Sucuzhanay, after Judge Patricia DiMango declared the mistrial.
