3 charged, 1 cleared in Bronx gang gay-bash

Three more members of a homophobic gang accused of taking part in a brutal gay bashing in the Bronx were indicted yesterday for the attack, prosecutors said.

Jose Dominguez, 22, Idelfonso Mendez, 23, and David Rivera, 21, were indicted on charges of gang assault and other offenses stemming from the brutal beating of a gay man, his older brother and two teenagers on Oct. 3.

A fourth suspect in the attack, Luis Garcia, 26, was indicted Tuesday on robbery and gang assault charges.

Meanwhile, prosecutors yesterday dropped charges against Dennis Piters, 17, for lack of evindence. Charges against three other teens were dropped earlier this week for the same reason.

“He did not take part in it. He’s not a homophobe, he’s not anti gay,” said Piters’ lawyer, Fred Bittlingmaier, after the charges were dropped. “He happened to be buddies with a couple of guys who — well, we’ll see what the grand jury says about them.”

“For the Bronx DA’s office to come out and say they investigated and they cannot get him on anything, not even robbery second degree, shows he didn’t take part in it,” Bittlingmaier said.

Three other defendants are awaiting grand jury action on hate-crime, robbery, sexual abuse and other charges for allegedly sodomizing two of the victims and slashing and burning them at an abandoned Osborne Place apartment.

All the attackers were described as members of the Latin King Goonies gang.
