B’klyn man sentenced to three months in jail for hiding weed in daycare center basement

The Brooklyn man who 10 pounds of marijuana in the basement of a daycare center was carted off to jail today despite his plea to remain free and protect his wife from the men who tried to rob his stash.

Sherwin Rogers was sentenced to three months in jail after pleading guilty in April to first-degree marijuana possession, a charge that carries a sentence of up to 15 years.

He and his wife Donna Rogers were arrested in June 2009 after robbers stormed the Special Moments daycare center in East Flatbush.

Cops got into a shootout with the robbers and one of the wounded perps told cops about the stash in the basement.

Rogers’ lawyer, Jack Goldberg, asked Brooklyn Supreme Court Justice Gustin Reichbach for a delay, saying the robbers were threatening his clients’ wife.

But Reichbach, after having allowed several delays already, noted that the deal was “very generous indeed” and ordered Rogers jailed.

“the circumstances of this offense are obviously very troublesome,” Reichbach said. “It made the kids vulnerable for exactly the kind of activity that happened here.”

Rogers, a former soldier, apologized for his “selfish acts.”

“My judgment was poor and terrible,” he said.

In addition to the jail stretch, Rogers must serve five years probation.
