MURDER ORPHAN ‘HAPPY’ WITH UNCLE

The law guardian for little Michelle Malakov – at the center of a bitter custody battle that ended in the murder of her father – hopes the 6-year-old girl is permanently adopted by her dad’s brother.

“I am supportive to the extreme of the uncle adopting the girl,” lawyer David Schnall told The Post yesterday. “She can be in no better place on this earth.”

Schnall, appointed four years ago to represent Michelle in the custody fight, said he has spent time with Gabriel Malakov and his wife, and “they are lovely people.

“Michelle is happy. She’s bright. She’s well-adjusted. Her best interest lies in staying where she is.”

Gabriel was granted temporary custody of the girl after her mother, Dr. Mazoltuv Borukhova, 35, was arrested in February 2008 and charged with paying a hit man $20,000 to rub out her husband, dentist Daniel Malakov, 34.

Borukhova and the hit man, Mikhail Mallayev, 51, were convicted Tuesday of first-degree murder.

Yesterday, Borukhova was taken to Elmhurst Hospital for reasons that weren’t immediately disclosed.
