Exclusive: First look into Albany’s ‘man cave’ shows drug-use, sleeping

ALBANY – Here’s are three portions of the secret video that was used by Attorney General Andrew Cuomo’s office to win guilty pleas today from two state workers who operated a “man cave” in a state garage, where they slept and allegedly used and sold drugs.

The first portion of the video, recorded by State Police investigators working with state Inspector General Joseph Fisch, shows Gary Pivoda, 48, and his supervisor Louis Marciano, 50, snorting what sources confirm is cocaine. The second shows them passing a joint of pot back and forth. The third shows Marciano sleeping as Fisch makes a bed and lies down.

The pair were accused last month in a 22-count indictment of allegations including drug possession and sales.

Pivoda was sentenced to a year in jail, while Marciano received five years probation as a result of their guilty pleas in Albany County Court.

Pivoda pleaded guilty to defrauding the government and grand larceny in connections with claims to have been working on state time when he was actually engaged in illegal conduct and will serve one year in the Albany County Jail.

Pivoda also will also reimburse the state $2,076 in pay that he wasn’t entitled to receive.

Marciano pleaded guilty to defrauding the government and received five years probation.

He also was sentenced to perform 250 hours of community service and pay the state $1,504 in salary reimbursement.

Both men also agreed to resign their current positions and to never seek public employment again.

A spokesman for Attorney General Andrew Cuomo, whose office prosecuted the cases, said that while drug sale and use “underlay’’ the charges against the two men the final pleas “were in satisfaction of all the original charges.’’
