Cruise, Holmes reach divorce settlement

Signed, sealed and almost delivered — Tom Cruise and Katie Holmes have apparently settled their divorce.

Lawyers for the actors said today they’ve hammered out a deal accepted by both the “Top Gun” and “Dawson’s Creek” stars.

“We are very pleased to confirm that the divorce action between Tom Cruise and Katie Holmes has been amicably settled,” said Holmes’ lawyer Allan E. Mayefsky.

Today’s deal comes less than two weeks since Holmes’ bombshell divorce filing in Manhattan Supreme Court.

“It was a team effort, and we appreciate the cooperation of Katie’s attorneys in this matter,” said Cruise’s lawyer Marilyn Chinitz, who worked with her fellow Blank Rome firm attorneys Sheila Riesel and Dylan Mitchell in representing the “Mission Impossible” star.

No details of the custody agreement were made public.

“That’s a private matter between the parties,” said Chinitz, who has previously represented another superstar actor in a matrimonial action, Michael Douglas.

Radar Online reported this afternoon that Holmes will have primary custody of their daughter Suri, 6.

While Cruise will enjoy visitation rights, Holmes’ nanny and bodyguards will reportedly be with Suri during her visits with the “Taps” dad.

Cruise will also be barred from talking about his Scientology faith with Suri, the Web site reported.

“Suri is Katie’s number one priority. Tom only has Scientologists that work for him and Katie insisted that her staff will always be with their daughter,” a source close to talks told Radar.

“Under terms of the settlement, Suri isn’t permitted to be exposed to anything Scientology related and this includes going to any Scientology churches, parties, etc. Katie made sure that this was ironclad in the agreement.”

Lawyers for Cruise and Holmes are scheduled to appear in a Manhattan courtroom a week from tomorrow. The case — filed by Holmes under “Anonymous v. Anonymous” — was still scheduled as of this afternoon, but that hearing now appears to be moot.

“The case has been settled and the agreement has been signed,” Holmes’ lawyer Jonathan Wolfe said in a prepared statement.

“We are thrilled for Katie and her family and are excited to watch as she embarks on the next chapter of her life.”

Cruise would be only days away from seeing his 6-year-old daughter Suri, who is reportedly at the center of divorce proceedings, according to “Entertainment Tonight.”

“We thank Tom’s counsel for their professionalism and diligence that helped bring about this speedy resolution,” Wolfe said.

Both sides said they’re dedicated to being the best parents possible.

“We are committed to working together as parents to accomplishing what is in our daughter Suri’s best interest,” according to a statement from Cruise’s rep Amanda Lundberg.

Lundberg said the statement is from both Cruise and Holmes.

“We want to keep matters affecting our family private and express our respect for each other’s commitment to each of our respective beliefs and support each other’s roles as parents,” according to the statement.

Holmes reportedly wanted out of their union in order to save Suri from the start of brainwashing by creepy followers of Cruise’s Church of Scientology.

The well-planned divorce filing came as Cruise was out of the country filming a new movie and Holmes secretly moved she and Suri into a high-security Chelsea apartment building.

They were spotted shopping at neighboring Whole Foods yesterday. But they’ve stayed indoors for most of these past 1½ weeks, away from sweltering heat and prying eyes.

Cruise, 50, has been married three times – to Holmes, Nicole Kidman (1990-2001) and Mimi Rogers (1987-90). Kidman and Rogers have generally kept quiet about their lives with Cruise and Scientology.

This was the first marriage for Ohio-raised Catholic Holmes, 33, who admitted she grew up with a school-girl crush on the Hollywood heartthrob Cruise.

The “All the Right Moves” actor Cruise famously went nuts for Holmes during their early courtship, highlighted by a strange incident on the “Oprah Winfrey Show” in 2005.

The wild-eyed actor professed his love for Holmes and jumped on Oprah’s couch with a crazed smile.

“I’m in love,” he joyously told Winfrey.

“I’ve never seen you like this,” Winfrey observed. “We’ve never seen you behave this way before.”
