Carter is guilty of wife beat

NY1 political anchor Dominic Carter was found guilty yesterday of attempted assault for beating his wife in their upstate home — and could be jailed for up to three months.

The conviction might also cripple his chance of returning to the airwaves.

“We are in the process of reviewing the court’s decision,” NY1 said.

The decision comes three weeks after The Post revealed that his wife, Marilyn, has filed multiple police reports since 2003 alleging he physically and verbally abused her.

Ramapo Town Justice Arnold Etelson, in a written decision, did not convict the journalist of the original misdemeanor assault charge, but instead found him guilty of the lesser attempted assault.

Etelson found “beyond any doubt” that Carter “committed the attack” on Oct. 22, 2008, when his wife originally told cops he punched, choked and kicked her .

But, Etelson wrote, her injuries did not meet the “impairment of physical condition or substantial pain” standard required for an assault conviction.

The judge also slammed Marilyn Carter’s trial testimony that she was attacked by a day laborer, calling it “nothing short of preposterous.”

“We still maintain that Mr. Carter is not the one who assaulted his wife . . . we will continue to fight this case,” said his lawyer, Martin Gotkin.

Carter will be sentenced Jan. 14.
