Axed workers’ legal spat over mob witness ‘pics’

The chief engineer at a Brooklyn federal building claims an obese former underling got him fired by lying to higher ups that he took photos of confidential witnesses meeting with US Attorneys and then shared the photos with his mobbed-up cousins.

Robert Truocchio claims in his Brooklyn Supreme Court lawsuit that a member of his department, 300-pound Kevin Smith, sought revenge after Trucchio fired the hefty engineer for threatening other employees at the Downtown Brooklyn building that houses the Eastern District US Attorney’s office.

“[Smith] called the FBI and falsely reported that he had seen [Truocchio] use his cell phone to take photographs of witnesses who were on the sixth floor of 271 Cadman Plaza …. [Smith] also falsely told the FBI that [Truocchio] had caused pictures of witnesses to be transmitted to members of organized crime,” Trucchio’s suit states, adding that he has two cousins who are mobsters.

But Smith said on Tuesday that he rightfully reported Trucchio for snapping pictures where it wasn’t allowed.

“He was taking photos of photo blow-ups of mob people, relatives of his and what not,” said Smith. “That’s why he was fired. He had the photos on his iPhone so I told the US Marshall because that’s not something you’re supposed to do.”

Smith said Trucchio was the one who was fired and that he resigned last month for unrelated reasons.

Spokesmen for the US Attorney’s Office and the FBI declined to comment.
