B’klyn judge loses patience with janitor accused of sex with 12-year-old girl

A Brooklyn judge lost her patience today with a janitor accused of repeatedly having sex with a 12-year-old girl in the school, saying she “wouldn’t be sad” if he went to prison for life.

Ambiorix Rodriguez, 33, who worked for a decade as a janitor at the Middle School of Marketing and Legal Studies in East Flatbush, grinned and nodded his head today as Supreme Court Justice Patricia DiMango pointed at him from the bench.

“Either you had sex repeatedly with this 12-year-old girl or you didn’t,” DiMango said. “But you know what? You know what you did.”

Prosecutors accuse Rodriguez of having sex with the pre-adolescent in a school basement between September 2010 and January 2011. Police got wind of the alleged molestation after the girl was heard talking about the encounters with friends on a school trip.

DiMango said prosecutors are considering a plea deal that would put the unmarried Rodriguez in prison for a decade. But no deal has been struck, and DiMango ordered the defense attorney to quickly discuss a plea with his client.

If convicted by a jury of the top charge — predatory sexual assault of a child — DiMango assured Rodriguez “you’ll go to jail for the rest of your life. And that doesn’t make me sad.”

DiMango said prosecutors would ensure that the parents had a chance to weigh in on any deal before it was struck.

Rodriguez’s attorney, Michael Sheinberg, said after the hearing that negotiations with the Brooklyn district attorney’s office are ongoing.

He declined to comment on the judge’s harsh words.

“There has been no firm offer,” he said. “We’re still trying to figure out if there will be one.”

Rodriguez was a Department of Education janitor for about 10 years before he was fired following his arrest in April 2011. Rodriguez was freed after posting bail of $15,000 and is due back in court on October 9.
