The judge in the vicious custody battle between Mel Gibson and gal pal Oksana Grigorieva won’t be stripping the embattled actor of his visitation rights, according to reports.
Sources tell TMZ.com that Gibson, whose alleged vile rants have recently flooded the public airwaves, will still get to see daughter Lucia during the day and have her sleep over one night a week.
Earlier it was learned that Gibson’s soon-to-be-ex-wife Robyn was coming out to support him in a sworn declaration filed with in court this morning.
“Mel never engaged in any physical abuse of any kind toward me before, during or after our marriage … Mel was a wonderful and loving father,” she wrote, TMZ.com reported.
The document was filed as part of the custody battle between Gibson and ex-girlfriend Oksana Grigorieva. Lawyers for both sides are in a Los Angeles courtroom today in the matter.
Grigorieva lawyers have said they will claim that the actor hit and bruised their 8-month-old daughter Lucia, and will provide photographic evidence to support the allegation, entertainment website RadarOnline reported.
The images reportedly show the infant with a bruise on her chin and will form crucial evidence as Grigorieva’s legal team asks the judge at the Los Angeles court to strip Gibson of his paternal custody rights.
A child abuse detective was in court today, according to TMZ.
Meanwhile, Radar released a fifth tape of Gibson’s vile rants.
At one point, he says, “I don’t have any f–king money!”
When Grigorieva calls him mean, he fires back: “Yeah, you know what mean is now, don’t you? So don’t call me mean when I’m nice to you. Because I’d like to show you what mean really is. Bitch … whore, gold digger! All true! You f–king proved it to me! If you’re ever interested in proving otherwise, let me know. If you don’t care, I know you know what you are too.
“Look at yourself. And look what you’ve done. Look what you’ve f–king done! Look at your son. He’s a f–king mess. You f–king excuse for a mother. You’re a f–king bitch!”
Grigorieva’s possible evidence that Gibson bruised their baby follows reports that he punched her in the face “more than once,” while she was holding Lucia during an argument on Jan. 6, in an incident being probed by the Los Angeles County Sheriff’s Department .
She is now expected to claim that the baby — who was two months old at the time of the alleged incident — was hit when Gibson lunged for her.
It comes as yet another explosive audio tape surfaced Wednesday, featuring Gibson demanding sex from Grigorieva and threatening to burn the house down.

“I deserve to be blown first, before the f–king jacuzzi,” Gibson is heard yelling as he heaves loudly over the phone, later adding: “OK, I’ll burn the goddamned house down but blow me first! How dare you?”
In previous recordings, he told his ex, “You need a f–king bat in the side of the head,” and said he hit her because she “f–king deserved it.” He was also heard to make a number of racist remarks.
Grigorieva reportedly made the secret recordings in order to protect herself following a number of arguments with Gibson preceding their split in April.
But Gibson’s lawyers claimed to have proof that the tapes were tampered with, celebrity website TMZ reported Thursday.
Representatives of the disgraced 54-year-old “Mad Max” star planned to present “concrete forensic evidence” to the Sheriff’s Department that the recordings were altered and edited prior to their publication across the world, sources told the website.
If such evidence exists it would hamper the department’s case for prosecution, as it must prove the tapes are authentic before handing them to the District Attorney’s office.
