Poster Boy dodges jail on judge’s goof

The subway vandal known as Poster Boy just barely dodged jail yesterday, thanks to an oversight by the judge sentencing him.

But Henry Matyjewicz, 28, was AWOL from court and never heard the news.

The “artist” — who slices up subway ads — had negotiated a probation deal with the DA late last year, a promise that evaporated when he was rearrested shortly after he pleaded guilty. Furious prosecutors asked Justice Michael Gary to revoke the deal and impose a jail sentence.

But Gary noted that the record of the Dec. 16, 2009, guilty plea did not contain his standard warning that the deal was off if Matyjewicz got collared again — so it was still on.

In an even weirder twist, Poster Boy himself didn’t show up for his own victory — meaning a warrant will be issued for his arrest.

“It should have been a happy day for him, but he wasn’t there,” said his lawyer, Kerry Gotlib.
