Family of National Guardsman killed by NYPD detective takes first step toward lawsuit

The family of an unarmed National Guardsman killed by police during a Queens traffic stop is taking first official step toward a lawsuit.

A lawyer for the family of Noel Polanco filed a notice of claim Wednesday against New York City and the detective who fired the fatal shot.

A grand jury last week refused to indict Detective Hassan Hamdy.

Polanco was shot Oct. 4 on the Grand Central Parkway. Authorities say the 22-year-old Polanco initially resisted police efforts to pull him over.

Hamdy’s lawyer says he fired after he saw Polanco reaching under his seat with both hands. Other people in the car dispute that.

The city law department said it would review the papers when it received a formal copy.
