WENDY’S GOT A SCREW LOOSE: SUIT

A Bronx man is suing Wendy’s, claiming he chipped his tooth when he bit into a screw that had been cooked into his burger.

Steven Encarnacion, a 36-year-old barber who filed suit in Bronx Supreme Court, says when he bit into a bacon cheeseburger at the Wendy’s on Boston Road in The Bronx in June 2006, he felt something hard – and out came the screw.

“I said, ‘Oh, my God!’ ” he recalled.

He claims he hasn’t returned to a Wendy’s since and has had only homemade burgers. “It was kind of disgusting,” he said. “If that could be in the burger, what else could be in the burger?”

He’s seeking an unspecified amount in damages.

“Wendy’s has a responsibility to the public to provide safe food,” said his lawyer, Ken Litman.

The owner of the restaurant, Lee Magnes, questioned whether Encarnacion had found a screw, noting he refused to hand it over to a manager, who still provided a refund.
