STATE PURSUES GRASSO

The New York Attorney General’s Office continued its never-ending battle yesterday to make former New York Stock Exchange boss Dick Grasso give back some of the $187.5 million compensation package that led to his 2003 ouster.

Seven judges on the state’s highest court sat through almost an hour of arguments from both sides. A final judgement is expected to come at the end of this month, or early July, and could determine whether the AG’s office, now occupied by Andrew Cuomo, takes the case to trail.

In addition to the discussion of whether the AG has the power to pursue the case, was whether Grasso was in the wrong for accepting the pay package. Solicitor General Barbara Underwood, who is representing Cuomo, argued it doesn’t matter the size of the compensation since the NYSE was at the time a not-for-profit organization.
