Ex-cop sues NYPD, says bad pepper spray ended career

A former NYPD cop has sued the city because her department-issued can of Mace didn’t work when she tried to arrest a struggling Brooklyn fare-jumper – leaving her with a career-ending injury, Brooklyn court documents state.

Brenderline Blake tried to arrest a fare-jumper at the Marcy Avenue subway station in 2010 and when the man began to argue and fight with her, she went to Mace him, the suit says.

“The Mace didn’t work and allowed the perp to assault her, and her injuries led to her retirement,” said her lawyer, Joseph Decolator, noting that Blake suffered a fractured hand and wrist.

Because of the injury, she retired from the NYPD and is on three-quarters disability, the lawyer said.

The city law department declined comment because it had not yet received a copy of the lawsuit.
