MLB open to negotiations, but if Yankees’ A-Rod fights suspension then life-time ban in play

Bud Selig has not been definitive yet on a penalty for the Yankees’ Alex Rodriguez and negotiations can still be had, but it is almost certain to be at least 150 games.

The commissioner could still seek a life-time penalty because he believes MLB can prove multiple years of PED use, impeding investigation and lying to investigators. That option still seems a last resort and would be only used if A-Rod fights the suspension. Yet, all signs point to A-Rod doing just that with the Yankees slugger possibly bringing on a new law firm on Tuesday. A lifetime sentence would be difficult to support in front of an arbitrator, as Rodriguez is currently viewed as a zero-time offender.

Selig also could say that Rodriguez violated the Collective Bargaining Agreement by impeding the investigation, which is separate from drug agreement, and ban A-Rod from playing even if he appeals. That would make it possible for Rodriguez not to get on field at all this season, which could set up big fight between union and MLB.

The suspensions for all Biogenesis players could be issued as early as Friday, as baseball continues to work towards securing deals for the players. It’s possible, though unlikely, that Rodriguez’s suspension won’t be announced till after Friday since his will exceed 50 games. The third baseman may not be alone in those fighting the suspension. Rangers outfielder Nelson Cruz could also appeal the suspension.

Yankees catcher Francisco Cervelli is among the group of about eight players — which includes Tigers shortstop Jhonny Peralta and former Yankees prospect Jesus Montero of Seattle — leaning strongly toward a plea. The players are expected to be suspended at least 50 games (standard for a first-time offense), plus a few more in the cases of those who lied during the investigation. Melky Cabrera, Bartolo Colon and Yasmani Grandal, all of whom previously failed drug tests and served suspensions, will not face any more discipline. Nor will Washington pitcher Gio Gonzalez.

Rodriguez is currently on the disabled list, having not played in a major league game this season due to offseason hip surgery followed by his famous quad strain, and is supposed to play in a minor league game or simulated game Friday.
