Judge hits cop-stab thug’s suit

Common sense prevailed yesterday in Brooklyn federal court, as a judge tossed most of the claims by a violent criminal who plunged a hunting knife into the skull of a cop and then had the nerve to sue the NYPD for excessive force in arresting him.

The jury will deliberate today over claims by Hugo Antonio Hernandez that he was beaten by responding officers while handcuffed as three officers failed to stop it.

Hernandez, who was sentenced to 20 years for plunging the 6-inch blade a quarter-inch into the officer’s brain, is acting as his own lawyer in the $45 million civil-rights case he brought against the city and the NYPD.

Judge Tucker Melancon tossed out all claims against Officer Angel Cruz Jr., a Marine Corps and Iraq War veteran, who was gravely wounded after Hernandez stabbed him on a Brooklyn subway platform.
