No charges likely in deadly postal truck accident

Authorities are not expected to bring charges against the US Postal Service truck driver who ran over and killed famed lawyer Alan Dershowitz’s sister-in-law, police sources said today — infuriating her family.

Erin Duggan, a spokeswoman for the Manhattan DA, said the case is still “under investigation” and could not say when a final determination would be made.

But NYPD sources said they did not anticipate charges being brought against driver Ian Clement, who fatally struck Marilyn Dershowitz as she and her husband, Nathan, were bike-riding on West 29th Street near Ninth Avenue in Manhattan on Saturday afternoon.

Clement kept driving, but a Postal Service spokesman insisted that he didn’t know he hit anyone.

Marilyn’s devastated widower, Alan Dershowitz’s brother, said Clement should face charges.

“You cannot crash into a person on a bike and keep going,” he said today.

A funeral for Marilyn — an esteemed, retired Manhattan Supreme Court special referee — is scheduled for 11:45 a.m. Tuesday at Riverside Memorial Chapel on West 76th Street in Manhattan.

Shiva will be observed inside their Tudor City Place home Tuesday through Thursday.

Phone calls to Clement’s home were not returned.
