Judge threatens Lohan with jail time if she takes plea

Lindsay Lohan turned heads yesterday as she strutted into to court in a sexy, cleav age-baring Cha nel blouse — only to hear a California judge tell her that her next fashion statement could be prison stripes.

Judge Keith Schwartz warned the frequently soused star he’d throw the book at her if she takes a plea bargain or pleads no contest to charges she ripped off a $2,500 necklace from a posh LA jewelry store last month.

“If you plead in front of me, if this case is resolved in front of me, you are going to jail — period,” Schwartz said.

“I don’t care if you’re Lindsay Lohan.”

The troubled tartlet, 24, who served 13 days in jail last July, was called into LA Superior Court to be formally presented with a plea deal that would settle the felony grand-theft charges filed against her.

Unlike earlier this month, when Lohan wore a sexy white Kimberly Ovitz dress for a court hearing, she opted for a high-end, tarty look yesterday.

“Thanks, Chanel and Lanvin and YSL and Tres Glam jewelry,” she told a reporter about her pants and top, clutch bag, shoes and bling.

The terms of the deal suggested by the DA weren’t announced in court, but TMZ.com reported it would involve six months behind bars.

With Judge Schwartz’s promise of jail, Lohan’s only chance of avoiding the clink is to go to trial and hope to be acquitted.

Lohan, who insists she is innocent and was freely given the jewelry by the store last month, told friends after yesterday’s hearing that she’s leaning toward going to trial, TMZ said.

If she takes a plea, she’ll be slapped with a probation violation for a 2007 DWI case. But if she refuses a deal, she could still face a probation violation that could put her behind bars before the theft trial starts.

Lohan has until March 10 to make up her mind.

In addition to his promise of jail, Schwartz also said Lohan, who has served multiple stints in rehab, needs to get help — from anyone but her mom, Dina, and dad, Michael.

“You need to get a reliable, trustworthy and reasonable sponsor who is not your family,” he told the actress.

“That will help you stay away from substance-abuse issues and alcohol-abuse issues. That will help you reach the full potential you have.”

The “Mean Girls” star’s mom was in the courtroom and didn’t react to the judge’s swipe. She later hustled out with her daughter. Neither commented.

But Lindsay’s dad admitted the judge was right.

“I think that’s a great idea,” Michael said.

“This case is never going to end unless her parents can put their differences aside, which I’m willing to, and stop playing this game.”

Michael Lohan also defended his daughter, saying she gets jewelry all the time and has a difficult time keeping track of it. He even gave the court a DVD he said was evidence proving she often gets free jewelry.
