Prosecutors yet to convene grand jury in Nederlander case

Manhattan prosecutors are taking their time with the felony girlfriend-bashing case against B’way scion Eric Nederlander.

At a quick-as-a-flop appearance in Manhattan Criminal Court, Nederlander was told prosecutors have yet to convene a grand jury, and left without speaking to reporters.

Nederlander’s girlfriend, Nancy Okun, had accused him in January of violating a protection order by yanking her hair while she was sleeping.

“You’re cheating on me!” he allegedly yelled.

Nederlander has denied the charges and remains free on $5,000 bond. He gave reporters a polite smile as he left the courthouse.

“There is no action yet by the DA,” lawyer Evan Lipton said.

According to court papers, Okun and Nederlander had last clashed July 19, during a late-night cab ride.

In this original case, Okun accused Nederlander of smashing her face into the cab’s Plexiglas partition while allegedly yelling, “Don’t get out of the cab. Please don’t do this to me. They’ll take her away–” in an apparent reference to his young daughter, Mira.

At the time, Nederlander was in a nasty custody battle over the girl with his second ex-wife, Lindsey Kupferman.

He was charged with assault and harassment, but Okun eventually declined to prosecute. Nederlander then pleaded guilty to disorderly conduct, a violation that would not leave him with a criminal record.

But in taking that plea, Nederlander had also signed a limited order of protection allowing him to continue seeing Okun — the two lived together in Okun’s apartment — but barring him from assaulting or threatening her.
