ABC’s “Glass House” will premiere as scheduled on Monday — after a judge denied CBS’s temporary restraining order.
US District Court Judge Gary Feess ruled yesterday that CBS — which claims “Glass House” is a direct ripoff of its “Big Brother” reality show — didn’t have a strong enough argument.
He also described both shows as “quite different television programs,” according to thewrap.com.
Feess also said that the elements of “Big Brother” — in which “housemates” live together for several months, cut off from the outside world and engaging in competitions — are generally known in and around the TV industry.
“A lot of things affect expression but are not expression, so they can’t be copyright protected,” Feess told CBS lawyers.
“We appreciate the court’s continuing consideration of this case and our request for an injunction,” CBS said in a statement.
“Win, lose or draw on the temporary restraining order, we intend to proceed with our claims against Disney/ABC for copyright infringement and misappropriation of trade secrets over ‘The Glass House, which may still warrant more injunction proceedings depending on the content of each episode.”
