Lawyer for survivor of dirt bike crash wants investigation

The lawyer for the surviving passenger on a dirt bike that was struck by a pursuing police car is demanding an investigation into what he called the use of for excessive force that left a Bronx man dead.

Cesar Gonzalez blasted the actions of the cops who arrested Aldalberto Gonzalez, 26, after the tragic chase that left building super Eddie Fernandez, 28, dead when the dirt bike he was driving smashed into a Hunts Point street pole.

Cops began chasing Aldalberto after he allegedly roared the wrong way down a one-way street on another dirt bike, then up a pedestrian filled sidewalk, before crashing and jumping on the back of Fernandez’s bike. Investigators said a police cruiser accidently struck the dirt bike.

“My client had the indignation of seeing his friend die but also being arrested for it,” Cesar Gonzalez said. “You talk about a loaded gun – this is a loaded squad car.”

The DA’s Office is awaiting an NYPD Internal Affairs investigation, a spokesman said. Aldalberto was released on a $750 cash bail. He is scheduled to return to court August 17th.
