Serial breast-barer Holly Van Voast gets charge she violated MTA hygene code dismissed

She had four busts. Now she’s left with three.

Serial breast-barer and performance artist Holly Van Voast won a judge’s dismissal today of charges that she violated the MTA’s hygiene code by riding bare-breasted through Manhattan on a Metro North train on June 3.

That leaves Van Voast, 46, of the Bronx, exposed to jail time on three remaining cases alleging she was disorderly, blocked pedestrians, and/or exposed herself elsewhere within the confines of Manhattan.

Manhattan Criminal Court Judge Jennifer Schecter today dismissed the single hygiene code violation for the topless train trip after Van Voast defense lawyer Ron Kuby argued that the regulation applied only to people using MTA facilities for washing and bathing.

“All that was charged against Ms. Voast was a naked allegation of toplessness,” Kuby quipped.

“She still has three outstanding busts,” Kuby deadpanned to The Post. “We will fight all of them on the same ground — that women are permitted to bare their breasts anywhere men are permitted to bare their breasts.”

In January, Van Voast allegedly strolled without her shirt up the center aisle of St. Patricks Cathedral, telling cops, “I have something to say. This is how I say it.”

Van Voast was charged in that arrest with criminal trespass, disorderly conduct, exposure and possession of marijuana for a bag of pot cops allegedly found in her purse.

She was arrested on the two remaining occasions for going topless at the subway station at Union Square East on June 7, and again at the subway station at 125th St. and Saint Nicholas Avenue on May 7.

The three remaining cases are back in court Oct. 2.
