Queens judge denies perv’s request to lower jail sentence to spend Christmas with family

A Queens judge slammed a pervert’s request to lower his jail sentence to be with his four children for Christmas.

“Give him four months or less judge, I ask this judge so he can be with his 13-, 11-, 9- and 7-year-old boys for Christmas,” pleaded Charles Oross’ attorney Donald Volgeman to Queens Supreme Court Justice Richard Buchter.

Moments later, an unmoved Buchter hit Oross with a six-month term.

Oross, 45 of East Islip, LI, plead guilty in September to having repeated sexual encounters with a 14-year-old student in a Susan B. Anthony IS 238 classroom and in his car, more than a dozen times in 2009.

“Your mess is your responsibility. If his concern was for him to be home for Christmas, he should have thought about that before having sex with an eighth-grader,” said Buchter, who read 12 letters from Oross’ pastor and other students’ parents, on behalf of the defendant.

The ousted social studies teacher’s wife, Wendy, blew the whistle on her now-estranged husband after investigating his Facebook account and reached out to the young girl.

“I’m not who I once was … I’ve lost friends, my grades fell, I have a bad temper,” said the now 17-year-old high school senior, who sought counseling for depression after the inappropriate relationship was reported.

“He convinced her that he loved her and it was a secret…the happy spirit that was once infectious has been torn apart because of you,” said his victim’s mother in a letter read by the prosecutor, Debra Bresnahan.

Oross wiped away tears as he read from a handwritten letter apologizing to his family, the court, his parents and his children. He faced his victim for the first time in three years and offered his sympathy and urged her to “not blame yourself.”

Volgeman argued that his client is a “changed man” and should have his sentence reduced. But the judge wouldn’t buy that argument.

“You’ve destroyed your reputation, caused your parents heartache, forever branded yourself as a predator, you’re a disgrace to a noble profession,” said Buchter.

The sex fiend will also serve 10 years probation, register as a level two sex offender and participate in a sex offender program.
