Feds settle ‘sex’ suit

The feds have agreed to pay a $175,000 cash settlement to a New York law-enforcement agent who filed suit against Janet Napolitano, claiming he was subjected to “sexually offensive behavior” by a confidante of the Homeland Security honcho.

The settlement was announced in a legal filing by the lawyer of plaintiff James Hayes, special agent in charge of New York City investigations for Homeland Security’s Office of Immigration and Customs Enforcement.

Napoilitano pal Suzanne Barr, the official named in the suit, resigned as chief -of-staff to the ICE director in September after the suit accused her of making lurid remarks to male employees and denying Hayes a promotion.

The suit alleged that during a conference, she called an employee “in his hotel room . . . screaming at him that she wanted his ‘c–k in the back of [her] throat.”

Barr was also accused of creating a “frat-house-type atmosphere that is targeted to humiliate and intimidate male employees.”

Hayes claimed he was passed over while less- qualified women who knew Napolitano got promoted.

The precise details of the agreement aren’t yet finalized, but sources told The Post the feds will not admit to any wrongdoing, and that Hayes will retain his job as head of ICE investigations in New York.

“The parties have come to an agreement in principal to settle this case for $175,000, along with other conditions, including that Mr. Hayes will remain employed with ICE,” according to the filing.

An ICE spokesman declined to comment.
