Subway ‘perv’ lucks out as judge dismisses case

He’s one lucky perv.

Jason Mack — a 250-pound city janitor — admits he drunkenly masturbated onto a 14-year-old girl on a crowded 1 train ten years ago.

Today, a judge dismissed the misdemeanor sex abuse charges against him because Manhattan prosecutors didn’t bring the case to trial in time.

“I don’t ever want to see you again,” Manhattan Supreme Court Justice Rene White told Mack before cutting him loose.

It’s the second stroke of legal luck for giant jerker, who successfully fought all the way to the state’s top court to get the original felony sex abuse charges dropped because the allegations did not involve actual physical contact.

“I feel great,” Mack, who hadn’t been linked to the crime by DNA until 2009, said after court.

“The court of appeals decided, as I had said all along, that this had been an over-indictment,” his lawyer, Michael Alperstein, told reporters.
