Dope’s 2nd DWI arrest at hearing

He’ll have another.

A Long Island repeat drunken driver appeared at his DWI court hearing yesterday reeking of alcohol, then hopped into his car and drove off — and was quickly rearrested, officials said.

Michael Nolan, 59, of Freeport, showed up at Nassau County court in Mineola for a status conference on an August aggravated-DWI charge — in which he had allegedly registered a 0.28 blood-alcohol level, more than three times the legal limit, said officials with the Nassau District Attorney’s Office.

But court officers and other staffers noticed that Nolan — who also has a misdemeanor drunken-driving conviction from 2004 — stank of booze and appeared unsteady on his feet, officials said.

At the DA’s request, a Nassau cop was assigned to tail Nolan leaving the courthouse, after his case was adjourned to a future date.

Nolan walked to the parking lot, hopped in his blue 2008 Toyota Tacoma and began driving away.

The tailing officer pulled Nolan over a few feet down the road and arrested him on a fresh drunken-driving charge, DA officials said.

He was transported to nearby Police Headquarters for processing.

His blood-alcohol level was not available yesterday, officials said.

Nolan’s lawyer, Garret Rooney, said his client had been unfairly targeted by the DA’s Office.

“This sounds to me like it was some kind of entrapment . . . to follow him out to his car like that,” said Rooney, adding that he had not been at yesterday’s adjourned hearing.

During Nolan’s August felony arrest, cops found a half-empty bottle of Hennessy in his car when he was stopped for driving unusually slowly around Freeport, according to Nassau DA officials.

“He wasn’t even driving the car that day,” Rooney insisted. “I expect him to be exonerated.”
