An EMT who allegedly was choked in an ambulance last November by a boozed-up Brooklyn assistant DA is furious that Manhattan prosecutors have held off on indicting the lawyer.
“They told me basically that they can’t prove intent because he was drunk,” EMT Teresa Soler, 46, of Yonkers, said of Michael Jaccarino, 30, and claims the ADA flashed his badge at her. “In my opinion, that means he knew what he was doing — and thought he was going to get a free pass.”
Prosecutors would need to prove Jaccarino acted intentionally to prove a felony-assault charge, which is the charge that they initially sought when Jaccarino was arrested.
Prosecutors said they are still looking into the incident.
Jaccarino was in court yesterday, but all that happened was a new court date was set.
