Lockup date for Astor son

The swindling son of philanthropist Brooke Astor appeared in a Manhattan courtroom yesterday to learn his tentative prison date — June 17, barring any success of an appeal.

Supreme Court Justice A. Kirke Bartley told a frail Anthony Marshall, 88, that he and his co-defendant, estate lawyer Francis Morrissey, can stay free on bail pending a decision on their bid by the Court of Appeals.

“You’re not going to jail, honey. It’s all right,” Marshall’s wife, Charlene (left), tearfully told him.

Marshall and Morrissey were both sentenced to up to three years’ jail after they were found in 2009 to have duped an ailing Astor out of $60 million in bequests.
