Catsimatidis isn’t done fighting OT lawsuit

Supermarket billionaire John Catsimatidis won’t accept losing — no matter what the cost.

The failed Republican candidate for mayor — who has already spent a fortune unsuccessfully trying to clear his name from a lawsuit that found he ripped off his Gristedes supermarket workers for overtime — is reaching into his deep pockets again in a desperate attempt to bring the case before the nation’s highest court.

The tycoon told The Post he plans to petition the US Supreme Court to take the nearly decade-old case, which has already cost him $7.4 million in settlement money and opponents’ legal fees. The news comes only two weeks after a deal in Manhattan federal court that was supposed to resolve the matter, with him agreeing to shell out another $645,000 in legal fees to the workers’ lawyers.

“This is not about money; it’s about overturning a decision,” said Catsimatidis, who is worth $3 billion.
