B’klyn slay-try mistrial

The attempted-murder trial of a Brooklyn dad who blasted a pack of rowdy teens with his assault rifle — hitting one in the neck — ended in a mistrial yesterday when the jury deadlocked on an assault charge.

Thomas Dunikowski, 32, of Marine Park, had testified he fired 27 shots at the drunken teens in June 2011 because he thought one had a gun and he feared for his wife and baby.

But while the Brooklyn Supreme Court jury would have agreed to acquit Dunikowski of the attempted-murder rap, they deadlocked over the equally serious assault charge.
